Under article 44.01(a)(5) of the Texas Code of Criminal Procedure, the State is entitled to bring a pretrial appeal of an adverse ruling on a motion to suppress evidence, regardless of whether the defendant alleges, or the trial court holds, that the evidence was "illegally obtained."
