BURDEN v. STATE OF TEXAS, 1698-99
Tex. Penal Code 43.23(c)(1), which criminalizes the promotion of obscenity, does not require a defendant to have knowledge that what he promotes is legally obscene, merely that a defendant have knowledge of the material's sexually explicit character and content.
