Court of Appeals of New York

People v. Johnson, 25

Conviction for robbery in the second degree is reversed where the admission of a non-testifying codefendant's out-of-court statements to establish an element of the crime violated defendant's Sixth Amendment right of confrontation under Bruton v. United States, 391 U.S. 123 (1968).
