People v. Rosario, 191
Convictions for misdemeanor offenses are affirmed where defendants' coram nobis applications, based on expiration of the one-year grace period of their time to appeal under CPL 460.30 and citing failure to timely appeal based on ineffective assistance of counsel under People v. Syville, 15 N.Y.3d 391 (2010), were properly denied where both defendants affirmatively waived their right to appeal in pleading guilty, failed to request their attorney file a notice of appeal, and otherwise failed to show unconstitutionally ineffective assistance of counsel entitling them such relief under Syville.
