Court of Appeals of New York

In re Suarez, 198

In a family law action, the Appellate Division is reversed and the court held that grandparents may demonstrate standing to seek custody under Domestic Relations Law section 72 (2) and Matter of Bennett v. Jeffreys, 40 N.Y.2d 543 (1976), based on extraordinary circumstances when a child lived with the grandparents for a prolonged period of time during an extended disruption of the mother's custody.
