Court of Appeals of New York

People v. Wragg, 152

Conviction and sentence for first-degree sexual abuse against a minor is affirmed where: 1) defense counsel's mistaken identity defense and related trial tactics were not constitutionally deficient as to deny defendant a fair trial; and 2) the court properly sentenced defendant as a second child sexual assault offender despite the People filing a predicate offender statement after trial.
