Court of Appeals of New York

People v. Martinez, 160

Sentence following convictions for multiple child sex offenses are affirmed where defendant's refusal of a plea deal for 10 years of probation, and later sentence of 10 to 20 years imprisonment after trial, does not constitute vindictive sentencing in violation of the New York State Constitution's Due Process Clause.
