People v. Hardy, 159
Convictions for four counts of grand larceny under Penal Law section 155.30 [4] and one count of petit larceny under Penal Law section 155.25 are affirmed where: 1) the trial court properly denied defendant's request for a circumstantial evidence because a surveillance video showing defendant hiding a pursue constitutes direct evidence of the 'taking' element of larceny; and 2) the trial court did not abuse its discretion by denying defendant's mistrial requests and issuing Allen charges to the jury.
