Court of Appeals of New York

People v. Israel, 171

Conviction for intentional murder in the second degree and attempted intentional murder in the first degree is affirmed where the trial court properly admitted rebuttal evidence to defendant's extreme emotional disturbance defense, and where admitted evidence that was more prejudicial than probative was harmless in light of the trial court's limiting instruction and overwhelming nature of the evidence.
