Adler v. QPI-VIII, LLC, 146

In a consolidated action involving three slip and fall cases dismissed where a defect on the ground causing plaintiff injuries was deemed too trivial to be actionable, the Appellate Division's dismissal of two of the complaints is reversed where the use of the trivial defect doctrine to prevail on a summary judgment motion requires a consideration of all the facts and circumstances presented instead of mechanical disposition on the basis of an object's dimensions.
