Court of Appeals of New York

People v. Martinez Baxin, 180

In an action appealing defendant's Sex Offender Registration Act risk level determination, the court held that the hearing court's reliance upon grand jury minutes that weren't disclosed to the defense violated defendant's due process rights but that the error was harmless in light of the overwhelming evidence establishing defendant's course of sexual misconduct against the victim.
