Matter of Soares v. Carter, 70

In an article 78 proceeding brought by the District Attorney, in an underlying prosecution stemming from defendants' participation in protest demonstrations in the City of Albany in support of the Occupy Movement, a writ prohibiting a lower court judge from requiring the People to pursue prosecution, namely by calling witnesses or putting on proof at the suppression hearing, is affirmed where the courts below properly granted the writ.
