In the Matter of Edwin Lopez v. Evans, 51
When a parolee lacks mental competency to stand trial, it is a violation of his or her due process rights to conduct a parole revocation hearing. The decisions of People ex rel. Newcomb v. Metz and Matter of Newcomb v. New York State Bd. of Parole should no longer be followed.
