In this case, defendant sought to obtain leniency on his first crime by providing information about a second, unrelated crime, but was charged with committing the second crime. The People offered in evidence statements that defendant made to the police when the lawyer who represented him in the first case was not present. Order denying plaintiff's motion to suppress is reversed, and a new trial is granted, where unlike in People v. McLean, the first case, and the lawyer's representation of defendant in it, were continuing when defendant was questioned about the second case, and under these circumstances, there was a violation of defendant's right to counsel.
