People v. On Sight Mobile Opticians, 222
In this case, defendant was convicted of violating section 57A-11 of the Town Code of the Town of Brookhaven by placing a sign advertising its business on public property, including the precise address and location of the offending sign. Order reversing the judgment of conviction and dismissing the informations and remitted fines paid is reversed, where: 1) in light of section 57A-11's independent legislative purpose, this signs provision can be severed from any unconstitutional portions of Chapter 57A; and 2) Chapter 57A-11 is constitutional.
