Coleson v. City of New York, 191

In this negligence action, plaintiff Coleson, a domestic violence victim, was told by defendant police officer various statements regarding her husband, such as "he's going to be in prison for a while" and "everything is okay, everything is in process." Coleson was later stabbed by her husband with a knife. Coleson asserts that she justifiably relied on the officer's statements. Summary judgment in favor of defendants is reversed, where the evidence presented in this case was sufficient to raise a triable issue of fact as to the existence of a special relationship between plaintiffs and defendants.
