People v. Sweat, 159

Order dismissing, on double jeopardy grounds, an information charging defendant Sweat with two counts of Criminal Contempt in the Second Degree is reversed, where double jeopardy does not bar a subsequent prosecution for contempt under the Penal Law if a court has not adjudicated defendant to be in criminal contempt or otherwise imposed punishment that is criminal in nature (and where subjecting a defendant to conditional imprisonment in an attempt to compel defendant to testify is not a qualifying punishment).
