People v. Polhill, 171
In this case, the Appellate Division reversed the decision of the Supreme Court and ordered that identification evidence be suppressed because the police lacked reasonable suspicion to stop and detain defendant on the street. The order of the Appellate Division is not appealable, where: 1) whether the circumstances of a particular case rise to the level of reasonable suspicion presents a mixed question of law and fact; and 2) the Appellate Division's reversal was not contingent upon the law or a determination of law alone.
