Court of Appeals of New York
People v. Ludwig, 166
In this child sexual abuse case in which the County Court permitted the People to elicit testimony about complainant's statements disclosing the abuse and precluded defendant's mother from testifying about a prior allegedly inconsistent statement made by complainant, the judgment of the trial court on these evidentiary rulings is affirmed, where: 1) the complainant's testimony was admissible for the non hearsay purpose of explaining to the jury how and when the sexual abuse came to light; and 2) defendant's mother's proffered testimony was inadmissible hearsay not subject to any exception.
