Powers v. 31 E 31, 153

In this personal injury action, plaintiff fell off the roof of an apartment building. Summary judgment in favor of defendants is reversed and remanded for further proceedings, where defendants failed to make a prima facie showing of entitlement to judgment as a matter of law with respect to whether the absence of a protective guard on the roof violated the building codes and whether the accident was foreseeable.
