Defendant's conviction of rape in the second degree, to which he pled guilty, is reversed and remanded, where: 1) there is no indication in the record that the victim was mentally incapacitated as defined under the relevant statute; and 2) it is not clear that defendant had a clear understanding of what he was doing when he entered his plea.
