State of New York v. John S., 75

Defendant's commitment as a dangerous sex offender in need of confinement following a Mental Hygiene Law article 10 trial, is affirmed, where: 1) the basis hearsay related to defendant's sex offenses that did not lead to valid adjudications of guilt, met minimum due process requirements and was properly admitted at trial; and 2) although basis hearsay about an uncharged rape was unreliable and should have been excluded, its admission was harmless error.
