The Appellate Division erred by vacating defendants' convictions for enterprise corruption, where: 1) the Appellate Division did not properly consider the elements of the crime under People v Western Express Intl. Inc. (19 NY3d 652 [2012]); 2) the trial evidence sufficiently established defendants' commission of enterprise corruption; and 3) the Appellate Division should reassess its weight of the evidence determination under the applicable statutory standards.
