Court of Appeals of New York

People v. Lewis, 39

Defendant's convictions of grand larceny in the third degree, three counts of grand larceny in the fourth degree, eight counts of criminal possession of a forged instrument in the second degree, five counts of identity theft in the first degree, and one count each of scheme to defraud in the first degree and criminal possession of forgery devices are affirmed, where: 1) the trial court did not err by submitting to the jury a verdict sheet containing the locations of the designated offenses; and 2) law enforcement's warrantless installation of a global positioning system (GPS) tracking device on defendant's vehicle was a violation of defendant's rights, but this violation was harmless beyond a reasonable doubt.
