Following defendant's conviction of intentional murder in the second degree, the Court of Appeal's denial of defendant's motion to challenge his conviction based on deprivation of meaningful legal assistance is reversed and remanded, where: 1) there were sufficient questions of fact as to whether defendant's attorney had an adequate explanation for his alleged deficiencies; and 2) defendant is therefore entitled to an opportunity to establish that he was deprived of meaningful legal representation.
