Country-Wide Insurance Company v. Preferred Trucking Services Corp., 21

In an action brought by plaintiff-insurer for a declaration that it was not obligated to defend and indemnify defendant-insureds in the underlying personal injury action, judgment that plaintiff is not obligated to indemnify defendant-driver and is obliged to indemnify defendant-company only up to the policy limit, is reversed and remanded, where plaintiff established as a matter of law that its delay in issuing its disclaimer of coverage was reasonable.
