Court of Appeals of New York

People v. Oddone, 236

Defendant's conviction for manslaughter in the first degree for causing the death of a man by holding him in a headlock is reversed and remanded for a new trial, where: 1) the trial court did not err in permitting the doctor who performed an autopsy on the victim's body, to testify that the victim's neck had been compressed for "something in the range of 2, 3, 4 minutes; but 2) the trial court erred in restricting defense counsel from refreshing a defense witness' recollection with a prior statement that the duration of the part of the incident she observed was "maybe 6 to 10 seconds."
