Court of Appeals of New York
People v. Hernandez, 211
The denial of defendant's post-judgment motion to vacate his sexual abuse conviction, made on the grounds of ineffective assistance of counsel, is affirmed, where there is support for the lower courts' determination that defendant failed to show a reasonable probability that, if counsel had informed him that he was certain to be deported as a result of his guilty plea, he would not have pleaded guilty and would have gone to trial.
