Court of Appeals of New York
People v. Asaro, 158
Defendant's convictions for manslaughter in the second degree and assault in the second degree are affirmed, where: 1) there was ample proof that defendant did more than merely drive faster than the legal limit; 2) the proof was sufficient to support the jury's conclusion that defendant acted recklessly; and 3) the trial court did not abuse its discretion by denying defendant's request to strike the entirety of the accident reconstruction expert's testimony.
