People v. Perrington, 151

Defendants' convictions of second-degree weapon possession are reversed and remanded, where: 1) the courts below erred in excluding the codefendant's statement to defendant's attorney that the gun belonged to her, and the error was not harmless; and 2) applying the correct legal standard, there was adequate evidence to establish admissibility as a declaration against penal interest under the particular facts of this case.
