People v. Marra, 124
Defendant's conviction for first degree rape is affirmed, where: 1) the trial judge did not abuse his discretion by allowing the photographs of the victim into evidence in view of the circumstances of this case, including the People's theory of physical helplessness; and 2) defense counsel's alleged failings, such as his neglect to object to the prosecutor's comment in summation about condom use, did not amount to ineffective assistance of counsel, and thus defendant received meaningful representation.
