Court of Appeals of New York

People v. Brinson, 135

The imposition on defendants of mandatory post-release supervision (PRS) to their determinate sentences at resentencing is affirmed, where the resentences do not constitute violations of the Double Jeopardy clause because defendants do not have a legitimate expectation of finality until they have completed their aggregated sentences under Penal Law section 70.30.
