In an insurance dispute arising from the plaintiff-insured's monetary settlement of a Securities and Exchange Commission (SEC) proceeding and related private litigation predicated on the plaintiff-insured's violations of federal securities laws, defendant-insurers are not entitled to a dismissal of the plaintiff-insured's coverage claims for indemnification regarding the SEC disgorgement payment, under CPLR 3211.
