Court of Appeals of New York

People v. Warren, 13

Conviction and sentence for murder was properly reversed, where: 1) a co-defendant waived a jury trial; 2) the trial judge improperly allowed said co-defendant to testify in front of the jury deciding defendant's case; and 3) the judge's failure to prevent the jury from hearing the co-defendant's defense was not harmless.
