Gress v. Brown, 203

In a suit brought by at-will seasonal employees of the City's Public Works Department, alleging that the Buffalo Fiscal Stability Act does not authorize or empower the Buffalo Fiscal Stability Authority (BFSA) to freeze or control their wages, the Appellate Division's judgment in favor of the plaintiffs is reversed where plaintiffs' challenge should have been raised by commencing a CPLR article 78 proceeding within four months after the BFSA's adoption of Resolution No. 04-35.
