Guryev v. Tomchinsky, 224

In plaintiff's suit for common-law negligence and violations of Labor Law sections 200 and 241(6), for sustaining on-the-job injuries renovating an apartment, judgment of the Appellate Division is affirmed where: 1) the condominium defendants were entitled to summary judgment because there was no lessor-lessee relationship between the condominium and the homeowners; and 2) since the homeowner-defendants, and not the condominium, own the apartment, the Board of Managers and the Board's managing agent are not the owner's agents within the meaning of the Labor Law.
