Court of Appeals of New York
Naughton v. Warren County, 222
In plaintiffs' suit against a county, alleging that the county's attempts to give the notice of foreclosure of their property were constitutionally inadequate, and seeking a declaration that they still owned the property, Appellate Division's decision affirming the grant of summary judgment in favor of the county is affirmed where: 1) the county was not constitutionally required to find other means of sending plaintiffs notice of foreclosure when the notice mailed to them at their last known address, proved undeliverable; and 2) plaintiffs have not been deprived of their property without due process of law.
