Metz v. State of New York, 208
In plaintiffs' suit against the State of New York alleging that it had been negligent in certifying an unsafe passenger capacity of a public vessel, resulting in injuries and lost lives due to the tragic capsizing of the vessel in 2005, the judgment of the Appellate Division is reversed where because the State owes no special duty to the plaintiffs, the claims that the State's inspectors failed to certify safe passenger capacity on the vessel must be dismissed.
