In parties' contract dispute over commercial real property, the appellate division's decision reversing the Supreme Court's award of statutory interest in addition to the down payment in favor of the seller, is reversed where the seller is not entitled to statutory interest because the terms of the contract trumps language in CPLR 5001(a) directing that a statutory interest be awarded in a contract dispute.
