In consolidated appeals of two separate criminal cases, involving claims of denial of the right to a public trial, the judgment of the Appellate Division is: 1) reversed and remanded for a new trial in People v. Alvarez where the defendant adequately preserved the argument that he was deprived of the right to a public trial when his family members were excluded from the courtroom during a portion of voir dire; but 2) affirmed as to People v. George because the defendant raised no objection, and thus, his claim is clearly not preserved.
