Court of Appeals of New York
People v. Solomon, 153
Defendant's conviction for sex-related crimes against his daughter over a four year period is reversed and a new trial ordered where: 1) there was no valid waiver of defendant's lawyer's conflict of interest in simultaneously representing, in an unrelated matter, a police officer who testified for the People that defendant had confessed to one of the charged crimes; and 2) there was an actual conflict of interest between defendant and the police officer in this case.
