Stephenson v. City of New York, 177

In plaintiffs' suit claiming that the school officials failed to ensure their son's safety from an assault by another student, the Appellate Division's grant of defendants' motion to dismiss the complaint is affirmed where none of the circumstances are present in this case which gives rise to a duty of care owed by the school to the student from an incident which occurred off-school premises and during off-school hours.
