In a firefighter's challenge to the decision of the Assistant Commissioner of the Fire Department to include a letter, advising him that he had violated the Department's Code of Conduct, in his permanent Equal Employment Opportunity file without affording him due process, the Appellate Division's decision to expunge the letter from petitioner's permanent EEO file is affirmed where because the letter issued to the firefighter constitutes a formal reprimand under Administrative Code section 15-113, the Department denied him the right to due process by placing the letter in his file without conducting a hearing.
