Town of Oyster Bay v. Kirkland, 163
In a town's action to dismiss an administrative complaint filed by the New York State Division of Human Rights (SDHR) challenging the town's preferential housing in favor of the town's residents was in violation of the Human Rights Law, the judgment of the Appellate Division is affirmed where this is not a case in which it would be futile to seek relief in the first instance through the administrative process, and as such, the town should initially address its constitutional claim, along with his defenses, to the SDHR.
