In a prosecution of defendants for various charges stemming from their involvement in trafficking stolen credit card information, the Appellate Division's reversal of the State Supreme Court's dismissal of the enterprise corruption count is reversed where under New York's Organized Crime Control Act, a "common purpose" is required and the structure of a criminal enterprise must be "ascertainable," and here, neither conditions are met in this case.
