Roberts v. Paterson, 120

In a suit brought by the New York City Off-Track Betting Corp., a public benefit corporation, against the state and the governor, and the mayor and the city of New York, seeking a judgment that the failure to fund, and the termination of, retiree health insurance and supplemental benefits violated section 12-126 of the New York City Administrative Code, judgment of the Appellate Division is affirmed, as plaintiffs did not demonstrate a likelihood of success on the merits of their claim against the city, and have stated no viable theory under which the state assumed the responsibility for funding health insurance and supplemental benefits in the first place.
