Court of Appeals of New York

In the Matter of Smith v. Hon. Tormey, 100

An Administrative Judge (AJ) does not have authority pursuant to 22 NYCRR section 127.2 (b) to considering an order of a trial court assigning an attorney, under article 18-B of the County Law, to a criminal proceeding, as section 127.2 (b) only provides for an AJ's review of orders awarding legal fees to attorneys, and does not authorize the AJ to review the assignment of counsel.
