In a prosecution of a police officer on multiple counts of perjury for falsely answering questions posed to him on cross-examination during the criminal trial of a man he interrogated: 1) the People's appeal from that portion of the Appellate Division decision reducing the convictions related to certain counts to perjury in the third degree is dismissed pursuant to CPL 450.90[2][a]; and 2) the Appellate Division's upholding of the other perjury convictions insofar as the officer appealed from it is affirmed, where the evidence was sufficient to support the finding that the false statement made by the officer that he never questioned the man was material to the man's trial.
