Court of Appeals of New York
Hahn Automotive Warehouse, Inc. v. American Zurich Insurance Co., 57
In litigation between an auto parts distributor and its insurer in which the insurer counterclaimed for breach of contract based on nonpayment of premiums, summary judgment to the plaintiff is affirmed, where the six-year statute of limitations barred the counterclaims, since it began to run when the insurer acquired the right to demand payment of the various amounts owed under the policies, and not when it sent the invoices.
