Court of Appeals of New York
Ryan v. Kellogg Partners Institutional Services, 37
In a suit by a securities broker against his employer for failure to pay wages and breach of an oral contract to pay a bonus, the Appellate Division's judgment in favor of the plaintiff is affirmed, where: 1) statements in the employment application and employee handbook did not defeat the plaintiff's claims; 2) the defendant could not successfully defend against enforcement of the oral agreements described by the plaintiff to the jury on the ground there was no signed writing; and 3) the plaintiff was entitled to an award of attorney's fees under Labor Law section 198(a-1) because the defendant's neglect to pay him the bonus--which constituted "wages" under section 190(1)--violated section 193.
